Acceptance and eligibility
These Terms of Service (“Terms”) are an agreement between you and Intelligent Edge Solutions LLC (the “Operator,” “we,” “us,” or “our”), which operates Picks. They govern your use of Picks’ websites, dashboard, public tools, smart links, reports, APIs, and related services (the “Service”). By creating an account, using the Service, or connecting a third-party account, you agree to these Terms and the Privacy Policy.
You must be at least 13 years old and legally able to enter this agreement. If you use Picks for a company, channel owner, client, or other organization, you represent that you have authority to bind that party and operate the content and accounts you place in the Service.
What Picks provides
Picks provides tools for inspecting, organizing, localizing, routing, monitoring, and updating product links. Results such as product availability, affiliate-tag presence, destination health, and regional matches are point-in-time observations. They are not a guarantee of commission credit, tracking-ID ownership, Associates eligibility, retailer approval, future availability, or revenue.
Features, limits, providers, and supported destinations may change. The Operator may impose reasonable usage, file-size, API, publishing, and quota limits to protect reliability and third-party services.
Free Link Covenant
The Free Link Covenant is the Operator’s commitment for Picks’ free-core link routing. Optional monitoring, automation, custom-domain, collaboration, data-retention, and other enhanced services may have separate prices or limits, but buying them is not required to keep an otherwise permitted free-core route available.
- Create unlimited smart links and send unlimited clicks without a Picks traffic bill.
- Picks uses only your Amazon affiliate tags and takes 0% of your commissions.
- Traffic growth or ending a paid plan does not disable an otherwise permitted smart link.
- Edit, disable, and export all your links anytime.
- A paid-plan downgrade keeps your last approved free routing setup in place.
In practical terms, free-core routing has no per-link or per-click fee. A complete link-map export means a portable export of the current Picks aliases and creator-approved routing configuration. It does not include credentials, third-party content, custom-domain registration or DNS service, retained click history, or features that are expressly outside the free core.
Necessary exceptions
The Operator may restrict, quarantine, change to a safer affirmative-choice experience, or disable a route when reasonably necessary to:
- comply with law, a court order, or another binding legal requirement;
- contain a security incident, malicious destination, vulnerability, or material threat to users or the Service;
- address fraud, abuse, deception, a material violation of these Terms, or infringement of another party’s rights;
- respond to a retailer or platform rule, technical change, withdrawn permission, invalid destination, or discontinued link format that makes the existing route unsafe, unlawful, or technically impracticable; or
- carry out an authorized account or workspace deletion request.
These exceptions do not permit the Operator to impose a traffic-based downgrade or paid-routing requirement on an otherwise permitted free-core link.
Service wind-down
If the Operator decides to discontinue the Service, the Operator will, where reasonably practicable, provide advance notice and a reasonable opportunity to make a free link-map export and repoint a creator-owned custom domain. A legal emergency, security event, provider failure, or other circumstance outside the Operator’s reasonable control may make advance notice or continued routing impracticable. No fixed post-shutdown forwarding or survival period is promised.
What the Covenant does not guarantee
The Covenant does not guarantee retailer attribution, affiliate commission credit or payment, Amazon Shopping app opening, uninterrupted service or uptime, destination availability, or review or approval by Amazon. It is not a representation that Amazon has approved Picks or a creator’s particular link placement. The creator remains responsible for affiliate-program eligibility, disclosures, registered properties, traffic sources, and compliance with applicable retailer and platform terms.
Accounts and workspace security
You are responsible for accurate account information, safeguarding access to your account, and actions taken by members or integrations you authorize. Tell us promptly if you suspect unauthorized access. You may not share credentials or API keys outside the people and systems you have authorized.
Your content and instructions
You retain ownership of URLs, descriptions, names, tags, domains, rules, and other content you submit. You grant the Operator a limited, non-exclusive license to host, copy, transform, route, display, and transmit that content only as needed to provide, secure, and improve the Service and carry out your instructions.
You represent that you have the rights and permissions needed for the content and accounts you use with Picks. You remain responsible for reviewing every proposed destination, disclosure, and description before publishing it.
YouTube API Services
Picks uses YouTube API Services. By using a Picks feature that uses YouTube API Services, you also agree to be bound by YouTube’s Terms of Service. Google’s handling of information is described in the Google Privacy Policy.
You may connect only a YouTube channel you own or are authorized to manage. Picks will clearly identify the selected channel, show proposed description changes, and require your express confirmation before a write to YouTube. You keep final control over what is published. Picks does not change video visibility and skips a video when its live description changed after your review.
You can revoke Picks’ access from the YouTube Optimizer or from Google’s third-party connections page. Revocation and data deletion are explained in the Privacy Policy.
Affiliate links and disclosures
You are solely responsible for your affiliate-program accounts, tracking IDs, disclosures, content, placement choices, and compliance with retailer agreements, platform rules, advertising laws, and consumer-protection requirements. Picks may provide disclosure fields or conservative guidance, but the Operator does not provide legal, tax, or compliance advice and does not determine whether your wording is sufficient.
You may not use Picks to conceal affiliation, impersonate another publisher, misdirect visitors, or interfere with a retailer’s attribution rules.
Acceptable use
You may not use the Service to:
- break the law, infringe rights, deceive, harass, or distribute harmful content;
- route to malware, phishing, counterfeit, prohibited, or materially misleading destinations;
- probe, disrupt, overload, bypass limits, or gain unauthorized access to the Service;
- scrape Google or YouTube, obtain scraped YouTube data, or use undocumented YouTube APIs through Picks;
- resell or sublicense YouTube API Services or YouTube API Data; or
- use another person’s channel, credentials, affiliate IDs, domains, or content without authorization.
Third-party services
The Service interacts with independent services such as Amazon, Google, YouTube, Cloudflare, Clerk, Oxylabs, Bright Data, Resend, custom domains, and integrations you configure. Their terms and privacy practices apply to their services. The Operator does not control a third party’s availability, policies, product data, tracking decisions, or account actions.
Picks ownership and feedback
The Operator and its licensors own the Service, software, design, documentation, and Picks brand, excluding your content and third-party materials. These Terms do not grant a right to copy, reverse engineer, or use Picks’ marks except as needed to use the Service. If you submit feedback, the Operator may use it without restriction or compensation, without identifying you publicly.
Suspension and termination
You may stop using Picks at any time and may disconnect third-party accounts from the relevant feature. The Operator may suspend or terminate access when reasonably necessary to address a Terms violation, security risk, legal requirement, nonpayment, abusive usage, or material harm to the Service or another party.
Termination ends your right to use the Service. Data is deleted or retained as described in the Privacy Policy. Disconnecting YouTube deletes the connected credential and related authorized data but does not remove content stored by YouTube.
Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” The Operator disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. The Operator does not warrant that a destination, API, product observation, affiliate tag, report, localization candidate, or published change will remain accurate or available.
Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, the Operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, commissions, data, goodwill, or business interruption arising from the Service or a third-party service. The Operator’s total liability for a claim will not exceed the amount you paid the Operator for the Service during the 12 months before the event giving rise to the claim, or US $100 if you paid nothing.
These limits do not apply where prohibited by law and do not limit rights that cannot legally be waived.
Changes and contact
The Operator may update these Terms to reflect changes to the Service, law, or third-party requirements. Material changes will be identified by a new “Last updated” date and, when appropriate, an in-product notice. Continuing to use the Service after the effective date means you accept the updated Terms.
